1. Acceptance of terms

By creating an account on theconsultant.chat or by using the TheConsultant service (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

TheConsultant is an AI-powered WhatsApp secretary that auto-replies to messages on your behalf. The Service uses browser automation to operate a personal WhatsApp Web session you have authenticated. The Service is provided on a software-as-a-service (SaaS) basis.

The Service is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc.

3. Subscriptions, billing & trial

• Plans are billed monthly in advance through the payment gateway you choose at checkout.
• A 7-day free trial is offered to new users. Cancel before the trial ends to avoid being charged.
• Subscriptions auto-renew at the end of each billing cycle until you cancel from the dashboard or the billing portal.
• Prices are quoted exclusive of taxes; applicable taxes (including Indian GST where applicable) are added at checkout.

4. Acceptable use

You agree not to use the Service to:

• Send spam, unsolicited bulk messages, scams or phishing content.
• Impersonate other people or businesses.
• Harass, threaten, defame or harm others.
• Distribute malware, illegal content, or content infringing third-party intellectual property.
• Reverse-engineer, scrape, or rate-limit-bypass the Service.
• Resell the Service or expose it as your own product without a written reseller agreement.
• Violate WhatsApp’s own Terms of Service or any other applicable laws.

5. Your account & WhatsApp connection

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. The Service stores your WhatsApp Web session inside an isolated container so it can keep replying while you are offline; you may disconnect at any time from the dashboard.

6. Account termination

You may close your account at any time from the dashboard. We may suspend or terminate accounts that:

• violate Section 4 (Acceptable use),
• have unpaid invoices more than 14 days past due,
• are found to be operating bot networks, spam farms or fraud,
• are subject to a binding legal order requiring termination.

On termination, your isolated WhatsApp container is destroyed and the attached browser profile is wiped. Account metadata is retained per the schedule in the Privacy Policy.

7. Service availability & warranty

The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability — WhatsApp Web, LLM providers, hosting infrastructure and the public internet can all fail. We aim for > 99% monthly uptime but do not commit to it under these Terms.

To the maximum extent permitted by Indian law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us during the three (3) months preceding the event giving rise to the claim.

8. Changes to the Service or Terms

We may update the Service or these Terms from time to time. Material changes are announced via email or the dashboard at least 14 days before they take effect. Continued use of the Service after the change constitutes acceptance.

9. Governing law & jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service is subject to the exclusive jurisdiction of the competent courts in India.
