Terms & Conditions
These Terms & Conditions (the “Terms”) govern your access to and use of the services provided by The Consultant (“we”, “our”, “us”) at theconsultant.chat and any related applications, APIs, dashboards, and WhatsApp-based agents (the “Service”). By creating an account, starting a trial, or paying for a subscription you agree to these Terms.
1. The Service
The Consultant is a software-as-a-service platform that provides conversational AI, WhatsApp virtual agents, and related automation tooling. The Service is delivered digitally; there is no physical product.
2. Accounts & eligibility
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of the information you provide and for any activity under your account.
- You must keep your login credentials and any API keys confidential.
3. Subscription, billing & trial
- The Service is offered on a recurring subscription basis (monthly or annual).
- New customers may be eligible for a free 7-day trial. If you cancel before the trial ends, you will not be charged.
- Unless cancelled, your subscription auto-renews at the end of each billing cycle at the then-current price.
- Prices are listed on each product’s own website and may include applicable taxes (e.g. GST in India).
- Cancellation, refund and proration rules are described in our Refund & Cancellation Policy.
4. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages, spam, or content that violates WhatsApp / Meta policies or applicable telecom regulations.
- Process content that is unlawful, harassing, defamatory, infringing, or that exploits minors.
- Reverse engineer, sublicense, resell, or attempt to gain unauthorised access to the Service.
- Use the Service to build a competing product, or to train a foundation model.
- Bypass rate limits, security controls, billing controls, or per-tenant isolation.
5. Customer data & AI processing
Conversations and content you process through the Service are handled according to our Privacy Policy. WhatsApp messages are processed in isolated, ephemeral containers per tenant and are not retained after the response is generated, unless you have explicitly enabled a logging or analytics feature.
We use third-party AI providers (currently Groq, Google Gemini, and Mistral) to generate responses. Your prompts may be transmitted to these providers for the sole purpose of producing a response.
6. Intellectual property
We retain all rights, title and interest in the Service, including all software, models, prompts and documentation. You retain ownership of the data and content you submit. You grant us a limited license to process your data solely to operate the Service for you.
7. Suspension & termination
- You may cancel your subscription at any time from your account dashboard.
- We may suspend or terminate your account for material breach of these Terms, non-payment, fraud, or activity that puts the Service or other customers at risk.
- On termination, your access ends at the end of the current paid billing cycle. Some metadata may be retained as required by law (see the Privacy Policy).
8. Disclaimers
The Service is provided “as is”. AI output may be inaccurate, incomplete, or unsuitable for a particular purpose. You are responsible for reviewing AI output before relying on it for regulated, medical, legal or financial decisions.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from or related to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential or punitive damages.
10. Governing law & dispute resolution
These Terms are governed by the laws of India. The courts at [Your City, India] shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your place of residence.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or through the dashboard at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
